Abstract
Conditions of detention are a major issue in the protection of the fundamental rights of persons deprived of their liberty in the Democratic Republic of the Congo. This study analyses detention conditions and their compliance with fundamental rights at the central prison of Bukavu, in South Kivu Province. It specifically examines the main difficulties related to prison overcrowding, access to health care, hygiene and food. The study adopts a qualitative approach combining documentary analysis, observation and a questionnaire survey involving 90 respondents, including detainees, prison officers, health workers, military or police officers, and magistrates. The findings show that overcrowding is a major concern: 100% of respondents acknowledge its existence, while 94.44% indicate that it affects prison cells. Furthermore, 88.89% of respondents report that detainees frequently suffer from illness, and 88.89% consider the prison health facility to be inadequately equipped. The absence of adequate hygiene services is reported by all respondents. Regarding food, 97.77% state that the food provided to detainees is insufficient, while 96.67% report that detainees generally receive only one meal per day. These findings highlight particularly precarious detention conditions and raise significant concerns regarding the protection of human dignity and the rights of persons deprived of their liberty. The study recommends strengthening prison infrastructure, improving access to health care, hygiene and food, and increasing the resources allocated to prison administration.
